MasterClass AI Terms

These AI Terms (the "AI Terms") apply when you access and use any MasterClass generative AI features, products, software, tools, services, documentation, content and functionalities that we make available to you through the Services (collectively, “AI Products”). These AI Terms are incorporated by reference into the MasterClass Terms of Service, located at https://www.masterclass.com/terms (the “Terms of Service”), and if applicable, the agreement between your organization and MasterClass that governs your use of Services. Any capitalized term used but not defined in these AI Terms has the meaning set forth in the Terms of Service. In the event of any conflict between certain provisions of the AI Terms and the provisions of the Terms of Service, the provisions of the AI Terms shall prevail over the conflicting provisions of the Terms of Service, solely with respect to the AI Products.



1. Use Restrictions:

All uses of the AI Products are subject to the provisions regarding user conduct set forth in the Terms of Service. In addition, you will not use any AI Products to: 

  • Generate or otherwise facilitate content that may (a) harm or promote harm to other individuals (such as self-harm, discrimination or bullying), (b) be pornographic, (c) violate or infringe upon the rights of others (including but not limited to intellectual property rights and privacy rights), (d) be hateful or highly offensive that attacks or dehumanizes a group based on race, ethnicity, national origin, religion, serious disease or disability, gender, age, or sexual orientation, or (e) be used for the purpose of engaging in regulated activities (such as political campaigning or lobbying); 
  • Include or attempt to generate anything containing the following: (a) information under regulatory or contractual handling requirements (e.g., Payment Card Industry Data Security Standards); (b) government issued personal identifiers; (c) biometric identifiers; (d) health information subject to the Health Insurance Portability and Accountability Act of 1996 or similar regulations; or (e) any data constituting “sensitive personal information,” “sensitive data,” “special categories of data”, or similar terms defined under applicable data protection laws; 
  • Violate any applicable law, or promotes, contributes to, or encourages illegal or unlawful activity; 
  • Deceive or mislead others (such as plagiarism, phishing, scams, and misinformation);
  • Solicit and/or rely on professional advice, such as medical, financial, or legal advice;
  • Modify or create derivative works of any AI Product; 
  • Override safety or privacy filters, controls, or mechanisms;
  • Sublicense, resell, time share, or similarly exploit any AI Product; 
  • Upload, post, transmit, or otherwise make available any content or information designed to interrupt, interfere with, destroy, or limit the functionality of any AI Product;
  • Reverse engineer, modify, adapt, or hack any AI Product, or otherwise attempt to gain unauthorized access to any AI Product or its related systems or networks; or 
  • Build a competitive product or service, including foundation models or other large scale models.


Any of your prompts and the results generated by AI Products may be reviewed through both automated (e.g., machine learning) and manual methods for abuse prevention and content filtering purposes. MasterClass reserves the right to investigate and take appropriate legal action against anyone who, in MasterClass' sole discretion, violates this provision, including without limitation, removing the offending content from the Service, suspending or terminating the account of such violators and reporting you to the law enforcement authorities. 



2. Inputs and Outputs:


Through your use of the AI Products, you may provide input for processing, which could include text, documents, images, videos or recordings (together, the “Inputs”). Such Inputs will be considered User Content under the Terms of Service. You may not submit any Inputs or use any AI Products in any anyway that (a) infringes, violates, or misappropriate any of our rights or the rights of any third party, (b) violates any applicable law, or (c) violates these AI Terms, the Terms of Service, or any MasterClass or third-party AI provider policies, including but not limited to OpenAI, L.L.C.'s usage policies and content policy. 


The AI Products will generate and return a response (the “Outputs”) based on your Inputs. When you use the AI Products, you are solely responsible for the development, content, operation, maintenance, and use of Inputs and Outputs. You acknowledge that due to the nature of machine learning and the technology powering the AI Products, Outputs may not be unique and the AI Products may generate the same or similar output to you or a third party. 



3. Third Party Providers:


The AI Products may use or be used in connection with content, services, features, and integrations provided by third parties, including, but not limited to, technology developed and provided by OpenAI L.L.C. MasterClass is not responsible for your use of third party content, services, features, and integrations, and you use these at your own risk. You acknowledge and understand that by using the AI Products, you will be required to comply with the applicable third party’s terms and policies, including, but not limited to, the OpenAI Terms of Service, each of which may change from time to time.



4. Privacy:


The Privacy Policy (available at https://privacy.masterclass.com/policies) governs your use and our processing of personal information related to the AI Products, including any personal information that may be contained in the Inputs. MasterClass may process personal information as described in the Privacy Policy, including to improve the AI Products and related technology.


When information is shared with the AI Products, the AI Products may retain and use that information to provide more personalized Outputs. Do not share information that you do not want the AI Products to retain and use. Do not share account identifiers or passwords. In addition, MasterClass may review your interactions with the AI Products, including the content of your conversations with or messages to the AI Products, and this review may be automated or manual. 



5. Disclaimers:


YOUR USE OF THE AI PRODUCTS IS AT YOUR SOLE RISK. THE AI PRODUCTS AND OUTPUTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. EXCEPT AS OTHERWISE EXPRESSLY PROVIDED HEREIN, MASTERCLASS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. MASTERCLASS MAKES NO WARRANTY THAT (I) THE AI PRODUCTS OR OUTPUTS WILL MEET YOUR REQUIREMENTS, (II) THE AI PRODUCTS OR OUTPUTS WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE AI PRODUCTS OR THE OUTPUTS WILL BE ACCURATE OR RELIABLE, OR (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE AI PRODUCTS WILL MEET YOUR EXPECTATIONS.


You are responsible for checking Outputs for accuracy and suitability. You should not rely on or use Outputs to inform professional advice or decisions related to medicine, finance, law, pharmaceuticals, or other important life matters. In addition, you should not rely on Outputs without independently fact-checking their accuracy. Outputs that appear accurate because of its detail or specificity may still contain material inaccuracies. The AI Products cannot dynamically retrieve information, and Outputs may not account for events or changes to underlying facts occurring after the relevant model was trained. YOU ALSO RECOGNIZE AND AGREE THAT YOU ARE SOLELY RESPONSIBLE FOR YOUR USE OF, AND/OR ANY ACTIONS YOU TAKE IN RELATION TO, CONTENT GENERATED BY THE AI PRODUCTS BASED ON YOUR INPUTS.


The AI Products may generate content that you consider to be offensive or objectionable, and/or that do not represent the views of MasterClass, our instructors, our mentors, our affiliates, or our personnel. The Outputs do not reflect the views of MasterClass, our instructors, our mentors, our affiliates, or our personnel. BY AGREEING TO THESE TERMS AND BY USING THE AI PRODUCTS, YOU RECOGNIZE AND ASSUME THE RISK THAT THE INPUTS YOU PROVIDE MIGHT RESULT IN GENERATION OF CONTENT THAT YOU CONSIDER OFFENSIVE OR OBJECTIONABLE.



6. Disputes:

 

Any claim, cause of action, or dispute that arises out of or relates to these AIs Terms is subject to the disputes resolution clause in the Terms of Service.



7. Modifications to the AI Terms:


We reserve the right, at our sole discretion, to change or modify portions of these AI Terms at any time. If we do modify these AI Terms, depending on the nature of the change, we will post the changes on this page and indicate at the top of this page the date these terms were last revised and/or notify you, either through the Services' user interface, in an email notification or through other reasonable means and as required by applicable law. Any such changes will become effective no earlier than fourteen (14) days after they are posted, except that changes addressing new functions of the AI Products or changes made for legal reasons will be effective immediately. Your continued use of any AI Products after the date any such changes become effective constitutes your acceptance of the new AI Terms.
